Below is a website-ready Terms of Service draft for Modus Transport.
Before publishing, have a transportation attorney review it and insert your correct legal entity name, address, MC/DOT numbers, insurance details, payment terms, and state-specific requirements. FMCSA defines brokers as companies that arrange transportation but do not physically transport cargo, while motor carriers physically transport regulated property for hire; your terms should match exactly how Modus is licensed and operating. Quotes are estimates unless confirmed in writing by Modus Transport.
Pricing may change if the customer provides incomplete, inaccurate, or incorrect information. This includes, but is not limited to, undisclosed lift kits, oversized tires, dual rear wheels, ladder racks, service bodies, utility beds, non-running condition, commercial equipment, added weight, rooftop accessories, or cargo inside the vehicle.
Large vehicles, commercial vans, dually trucks, heavy-duty pickups, service trucks, and modified vehicles may require special handling, additional equipment, or adjusted pricing.
The customer is responsible for providing complete and accurate shipment information before booking.
The customer must disclose:
The customer is responsible for ensuring the vehicle is available, accessible, and ready for pickup at the agreed location.
If the vehicle cannot be loaded due to inaccurate information, unsafe condition, restricted access, missing keys, dead battery, mechanical failure, or undisclosed modifications, additional fees may apply.
A vehicle inspection may be completed at pickup and delivery.
The customer or authorized representative should inspect the vehicle carefully at both pickup and delivery. Any visible damage should be documented on the Bill of Lading, inspection report, or delivery paperwork before signing.
Photos or video may be used to document vehicle condition.
Signing the delivery paperwork without noting damage may indicate that the vehicle was received in acceptable condition, subject to applicable law and carrier policies.
Unless approved in writing by Modus Transport, vehicles should be shipped empty.
Personal items, tools, equipment, loose cargo, valuables, electronics, documents, firearms, hazardous materials, illegal substances, cash, jewelry, and household goods should not be left inside the vehicle.
Modus Transport is not responsible for loss, theft, damage, or removal of personal items or cargo left inside the vehicle.

Pickup and delivery dates are estimates unless specifically confirmed in writing as guaranteed.

The customer is responsible for ensuring that pickup and delivery locations are accessible for transport equipment.
Large trucks, trailers, and commercial transport vehicles may not be able to access narrow roads, residential streets, low-clearance areas, gated communities, cul-de-sacs, steep driveways, restricted lots, or areas with low-hanging trees or power lines.
If access is restricted, the customer may be required to meet the driver at a safe, legal, and accessible nearby location.
The customer must disclose whether the vehicle does not run, does not drive, does not brake, does not steer, has no keys, has a dead battery, or requires special loading equipment.
Non-running vehicles may require winching, special equipment, additional labor, or different transport arrangements.
Additional charges may apply if a vehicle is represented as running but cannot be safely loaded or unloaded under its own power.
Vehicles larger than standard passenger cars may require special review before booking.
This includes, but is not limited to:
The customer must provide accurate dimensions, weight, and modification details when requested.
Failure to disclose oversized or modified vehicle details may result in price adjustment, delay, refusal of transport, cancellation, or additional fees.
Payment terms will be provided at the time of booking or invoice.
Payment may be required in full or in part before pickup, during transport, or before delivery, depending on the shipment arrangement.
Accepted payment methods may include credit card, ACH, wire transfer, certified funds, or other approved methods.
Unpaid balances may delay pickup, delay delivery, or result in storage, collection, administrative, or cancellation fees.
Chargebacks, reversed payments, failed payments, or disputed payments may result in suspension of service, collection activity, legal recovery, and additional fees where permitted by law.
Cancellation and rescheduling requests must be submitted as soon as possible.
Cancellation fees may apply once a shipment has been scheduled, assigned, dispatched, or accepted by a carrier.
If the driver, carrier, or transport equipment is already en route, additional cancellation or dry-run fees may apply.
Modus Transport reserves the right to cancel, refuse, or reschedule transport due to unsafe conditions, inaccurate vehicle information, nonpayment, inaccessible locations, improper documentation, customer unavailability, or circumstances beyond our control.
The customer or authorized representative must be available to receive the vehicle at delivery.
If the customer is unavailable, refuses delivery, fails to pay required balances, or cannot be reached, the vehicle may be held, stored, or delivered to a safe alternate location at the customer’s expense.
Storage, redelivery, administrative, and additional transport fees may apply.
Any claim for vehicle damage must be reported immediately upon delivery and documented before signing final delivery paperwork whenever possible.
The customer should provide:
Damage claims may be denied if the claimed damage was not noted at delivery, was pre-existing, was caused by mechanical condition, was caused by unsecured personal items or cargo, resulted from normal road exposure, or resulted from circumstances outside the carrier’s control.
Modus Transport is not responsible for mechanical failure, leaking fluids, worn parts, dead batteries, alignment issues, suspension failure, convertible tops, soft tops, aftermarket accessories, loose parts, personal items, or damage caused by undisclosed vehicle conditions.
